OUR RESEARCH

Legal Implications of Political Philosophy: John Rawls

The first dimension of research conducted within this framework involves an examination of political philosophy from a legal perspective. Specifically, it concerns the interpretation of John Rawls’s thought through the use of categories derived from legal scholarship (including legal theory and philosophy, constitutional law, and politico-legal doctrines). The second dimension focuses on the hermeneutics of law through the lens of political philosophy. This research seeks to uncover the deep structure and philosophical foundations of legal institutions characteristic of liberal democracy. Such an approach may prove useful in legal interpretation—especially dynamic interpretation—and can also serve as a basis for critical legal analysis, as well as a source of normative postulates for legislation or constitutional reform.

The most important outcomes of this research to date include the concept of law as an instrument of cooperation, the open model of justification as part of a theory of non-arbitrary law, and a distinctive formulation of legal non-positivism inspired by Rawlsian philosophy.

This stream of research was financially supported by the National Science Centre within the framework of a project entitled ‘The law as a device of fair cooperation in a democratic society. Political philosophy of John Rawls’ (2012/07/N/HS5/01017).
